Sometimes, depending on the estate's authority (independent vs. supervised administration). Your attorney will tell you. We're flexible either way.

How long does a typical probate sale take?

If probate is already open and the executor has authority, we can close on our normal 2–4 week timeline. If probate is still pending, we can enter into a purchase agreement now with closing contingent on probate closure.

What if there are outstanding liens or mortgages?

Common in probate. The title company clears them at closing from the sale proceeds. You typically don't need to resolve them upfront.

Can you buy if the will is being contested?

Not until the contest resolves. We can hold an agreement in place with a longer close, but we won't close over an active dispute.
